1. Agreement to these Terms

By downloading, installing, accessing, or using MyFitness, you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms apply together with Apple’s App Store / Mac App Store terms and any applicable Apple media services terms that govern your purchase, download, and use of apps on macOS and iOS.

2. The service

MyFitness is a fitness product family for Apple platforms. On macOS and iOS it helps you build AI-assisted or local workout plans, browse a bundled exercise library, run guided sessions, manage a training calendar, and track progress. On iOS it may also include nutrition setup, food logging, and calorie-related tracking. Features may include profile setup, plan generation, exercise browsing, workout sessions, streaks, progress insights, nutrition tools (iOS), and optional MyFitness Premium capabilities.

Feature availability may differ between the Mac and iOS apps. We may update, add, remove, or change features from time to time. We do not guarantee that any particular feature will remain available indefinitely.

3. Eligibility

You must be at least 13 years old to use MyFitness. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.

You represent that you have the legal capacity to enter into these Terms and that your use of the App complies with applicable law.

4. License to use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use MyFitness on Apple-branded products that you own or control, as permitted by the applicable App Store or Mac App Store usage rules for the platform you use.

You may not:

• Copy, modify, distribute, sell, lease, or sublicense the App or its content, except as expressly allowed by law or these Terms.
• Reverse engineer, decompile, or attempt to extract source code from the App, except where applicable law prohibits this restriction.
• Remove proprietary notices, or use the App to build a competing product by improperly extracting its content or structure.
• Use the App in any unlawful, harmful, or abusive manner, or in a way that interferes with its normal operation.

5. Your account of use and local data

MyFitness is designed primarily around on-device data. Profile details, workout plans, session history, nutrition logs (where available), and related progress information are stored locally on your Mac or iPhone/iPad. You are responsible for the accuracy of information you enter and for maintaining appropriate backups of your device.

Deleting the App or clearing its local data may permanently remove information stored on your device, subject to how macOS, iOS, and your backups retain files.

6. Health and fitness disclaimer

MyFitness provides general fitness and (on iOS) nutrition-related information, workout suggestions, exercise descriptions, food logging tools, and planning features for informational and personal training-support purposes only. The App is not a medical device and does not provide medical advice, diagnosis, or treatment. Calorie and macro estimates are approximations and may be incomplete or inaccurate.

Always consult a qualified healthcare professional before beginning any exercise program or changing your diet, especially if you have injuries, medical conditions, or other limitations. You assume all risk associated with physical activity and dietary decisions made while using or following content from the App.

Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, or any other concerning symptoms. We are not responsible for injuries, health outcomes, or decisions you make based on App content.

7. AI workout plan generation

When you request an AI workout plan, MyFitness may send selected fitness-profile and preference data to a third-party AI provider (currently OpenAI) solely to generate plan structure. Exercise matching and assignment are completed locally from the App’s bundled exercise catalog. If AI generation fails, the App may create a local fallback plan.

AI-generated plans are automated suggestions, not personalized coaching from a human trainer or clinician. Results may be incomplete, inaccurate, or unsuitable for your circumstances. You remain responsible for reviewing plans and exercising safely within your abilities and medical guidance.

8. Premium subscriptions and purchases

Certain features may require MyFitness Premium or other in-app purchases. Purchases and subscriptions are processed by Apple through the Mac App Store or the App Store (iOS) and StoreKit, depending on which app you use. Pricing, billing periods, free trials (if offered), renewals, cancellations, and refunds are governed by Apple’s terms and policies.

• Subscriptions may auto-renew unless canceled through your Apple ID subscription settings before the renewal date.
• You can manage or cancel subscriptions in your Apple account settings on your Mac, iPhone, iPad, or other Apple devices, or via Apple’s subscription management page.
• Payment will be charged to your Apple ID account at confirmation of purchase. Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription where applicable under Apple’s rules.
• We do not receive or store your full payment card details.
• Feature access depends on valid entitlement status reported by Apple’s billing system for the platform where you subscribed.

9. Intellectual property

MyFitness, including its software, design, branding, exercise library content as presented in the App, text, graphics, and related materials, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer ownership of any intellectual property to you.

“MyFitness,” “MyFitness: Gym & Home Workouts,” and “MyFitness: Calorie Tracker” are used to identify the product. You may not use our names, logos, or branding in a way that suggests endorsement or affiliation without our prior written permission.

10. Third-party services

The App may rely on third-party services to operate certain features, including Apple for distribution and billing, and OpenAI for optional AI plan generation. Your use of those services may also be subject to the third party’s own terms and privacy practices. We are not responsible for third-party services we do not control.

11. Privacy

How we handle information is described in our Privacy Policy for MyFitness. By using the App, you acknowledge that policy. Questions about privacy may be sent to info@softpixel.uk.

12. Disclaimer of warranties

To the maximum extent permitted by law, MyFitness is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, secure, or that workout plans, exercise information, or progress metrics will meet your expectations or produce specific fitness results.

13. Limitation of liability

To the maximum extent permitted by law, we and our affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) MyFitness.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the App will not exceed the greater of (a) the amount you paid us for MyFitness Premium or in-app purchases in the twelve (12) months before the claim, or (b) zero if you have not paid us directly for such access through Apple in that period. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent allowed by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless MyFitness and its affiliates from and against claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the App, your violation of these Terms, or your violation of any law or third-party right, except to the extent caused by our willful misconduct.

15. Termination

You may stop using MyFitness at any time by deleting the App and canceling any active subscription through Apple. We may suspend or terminate access to features, or stop offering the App, if you violate these Terms, if required by law or Apple, or if we discontinue the product.

Sections that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property provisions) will survive.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of MyFitness after an update means you accept the revised Terms, except where applicable law requires additional notice or consent.

17. Governing law

These Terms are governed by the laws applicable in your place of residence and by any mandatory consumer protections that apply to you, without regard to conflict-of-law principles that would require another jurisdiction’s law. Nothing in these Terms limits rights you may have under mandatory local law.
